I don't think warranty wouldn't apply in this case. 1) I believe warranty was one 1-2 years, and only applied to the original owner; and 2) a neck twist could be the result of being subjected to extreme humidity and/or temperature changes over time, which isn't something typically covered under warranty. 

I'd find a good luthier to take a look and see what they can do. Hope it's a quick easy fix!
