So he has the right to reproduce the guitar. Heritage can not! I find this doubtful, as a design patent is only good for 14 years. Thus any patent granted before 2003 would be expired. Even if he were listed on a Gibson patent, he would not be eligible to use it as the holder would have been the company since he was an employee.
